26 июня в ходе обсуждения порядка применения вооруженных сил президент Украины Владимир Зеленский заявил о целесообразности передачи командирам всех уровней максимальной инициативы и полномочий в принятии решений. Об этом говорится в комментарии Уполномоченного по правам человека в ДНР Дарьи Морозовой.

«Сделано это якобы с целью сохранения жизни и здоровья личного состава. В то же время президент Украины забывает, что в соответствии с нормами международного гуманитарного права главным приоритетом государства является минимизация рисков и угроз для мирного населения. В последнем отчете ООН докладчики акцентируют внимание правительства Украины на разработке нормативной базы по защите гражданских лиц и гражданских объектов при ведении боевых действий. Однако заявления президента Зеленского идут вразрез с рекомендациями авторитетной мониторинговой миссии.

Считаю, что в условиях эскалации насилия, которая в настоящее время наблюдается на территории Донбасса, реализация данного предложения будет способствовать дальнейшему ухудшению ситуации в сфере прав и свобод человека, а также закреплению практики грубых нарушений международного гуманитарного права, в том числе в части применения запрещенных методов ведения военных действий со стороны вооруженных формирований Украины.

Если предложение Зеленского найдет нормативное подкрепление, очень скоро мы станем свидетелями обострения конфликта и значительного ухудшения социально-гуманитарной ситуации в Донбассе.

Призываю мировое сообщество и международные правозащитные организации предельно внимательно отнестись к данному предложению президента Украины и воспрепятствовать его реализации с целью недопущения нового витка насилия в регионе, а также обеспечения соблюдения прав и свобод жителей Донбасса», — отметила Морозова.


On June 26th, during the discussion of the procedure for the use of armed forces, president of Ukraine Vladimir Zelensky declared the advisability of giving commanders of all levels maximum initiative and decision-making powers. Commissioner for Human Rights in the DPR Darya Morozova commented on this.

“This is done supposedly to save the lives and health of the military personnel. At the same time, the president of Ukraine forgets that in accordance with the regulations of international humanitarian law the main priority of the state is to minimize the risks and threats to the civilian population. In the latest UN report, the rapporteurs draw the attention of the Ukrainian government to the elaboration of a regulatory framework for the protection of civilians and civilian objects during combat operations. However, president Zelensky’s statements are contrary to the recommendations of the reputable monitoring mission.

I believe that in the context of escalating violence, which is currently noted in the territory of Donbass, the implementation of this proposal will further worsen the situation in the sphere of human rights and freedoms, as well as consolidate the practice of gross violation of international humanitarian law, including the use of prohibited methods of warfare by the armed formations of Ukraine.

If Zelensky’s proposal is signed into law, very soon we will witness an escalation of the conflict and a significant deterioration of the social and humanitarian situation in Donbass.

I call on the world community and international human rights organizations to give serious consideration to this proposal of the president of Ukraine and prevent its implementation in order not to let a new round of violence in the region happen, as well as to ensure observance of the rights and freedoms of Donbass residents,” Morozova emphasized.
