Сегодня, 14 мая, согласно повестке пленарного заседания, депутаты рассмотрели законопроект «О внесении изменения в статью 77 Закона Донецкой Народной Республики “О налоговой системе», разработанный депутатом Народного Совета, заместителем председателем Комитета по промышленности и торговле Евгением Орловым. Представил законопроект его инициатор, сообщает пресс-служба парламента.
«Данным проектом закона предлагается подтверждать первичными документами работы по ремонту, реконструкции и модернизации основных средств. Перед ремонтом объекты основных средств обследуются специалистами. Результаты осмотра, а также предложения и рекомендации об объемах и продолжительности намеченных работ передаются руководителю предприятия. Решение о проведении и характере ремонта или модернизации, вызывающих необходимость остановки основного средства на длительное время, оформляется приказом руководителя организации.
Также, перед тем как приступить к ремонту или модернизации, назначается специальная комиссия на предприятии, которая производит осмотр основного средства, а также составляются график работ и соответствующая сметно-техническая документация. В смете отражаются все этапы работ, их стоимость и затраты труда, перечень и стоимость материалов, общая стоимость работ и другие показатели. Заключительным первичным документом, который подтверждает проведение работ, связанных с достройкой, дооборудованием, реконструкцией, модернизацией, техническим перевооружением основных средств, определяется акт приема-сдачи. Типовая форма акта приема-сдачи будет разработана Министерством финансов ДНР в течение 30 календарных дней после опубликования закона на официальном сайте Народного Совета.
Необходимость данных изменений обусловлена тем, что в Донецкой Народной Республике отсутствуют независимые эксперты, аккредитованные в соответствии с действующим законодательством и имеющие право выдавать заключения, которые подтверждают расходы предприятия, связанные с достройкой, дооборудованием, реконструкцией, модернизацией, техническим перевооружением основных средств», – пояснил депутат.
Исходя из того, что предложенные изменения усовершенствуют законодательство в сфере налогообложения, парламентарии проголосовали за принятие законопроекта в двух чтениях в целом. Далее Закон ДНР «О внесении изменения в статью 77 Закона Донецкой Народной Республики “О налоговой системе» будет направлен на подпись Главе ДНР и вступит в силу через 30 дней после опубликования на сайте Народного Совета.
Today, on May 14th, according to the agenda of the plenary session, deputies reviewed the draft law On Amendments to Article 77 of the Law of the Donetsk People’s Republic On the Taxation System, which was developed by deputy of the People’s Council, Deputy Chairman of the Committee for Industry and Trade Yevgeny Orlov. The initiator presented the draft law; the press service of the parliament reports.
“This draft law talks about the possibility of confirming works on repair, reconstruction and modernization of permanent assets with primary documents. Before repairs, permanent assets are examined by experts. The results of the inspection, as well as proposals and recommendations on the scope and duration of the planned work are transmitted to the head of the enterprise. The decision on the conduct and nature of the repair or modernization, causing the need to shut down the permanent asset for a long period, is made by order of the head of the organization.
Also, before proceeding with repairs or upgrades, a special commission is appointed at the enterprise, which performs an inspection of the asset, as well as a schedule of work and the corresponding estimates and technical documentation are drawn up. The estimate report documents all stages of work, their cost and labor costs, the list and cost of materials, the total cost of work and other indications. The final primary document, which confirms the work related to the completion of the construction, fitting out, reconstruction, modernization, technical re-equipment of permanent assets, is considered a delivery and acceptance certificate. The standard form of the delivery and acceptance certificate will be elaborate by the Ministry of Finance of the DPR within 30 calendar days after the publication of the law on the official website of the People’s Council.
The need for these amendments is due to the fact that there are no independent experts in the Donetsk People’s Republic who are accredited in accordance with the current legislation and have the right to issue conclusions confirming the company’s expenses related to the completion of the construction, fitting out, reconstruction, modernization and technical re-equipment of permanent assets,” the deputy explained.
Given that the proposed amendments will improve the legislation in the field of taxation, the parliamentarians voted to adopt the draft law at two readings as a whole. Further, the DPR Law On Amendments to Article 77 of the Law of the Donetsk People’s Republic On the Taxation System will be submitted to the Head of the DPR for signature and shell enter into force 30 days after its publication on the website of the People’s Council.
