In an effort to prove himself and disavow the plan for the deportation of the people of Donbass, Secretary of the National Security and Defense Council of Ukraine A. Danilov has once again confirmed the authenticity of the document posted on the Internet on November 12, 2019, statement for the official website of the DPR given by a lawyer and the Chairperson of the Committee on Criminal and Administrative Law of the DPR People’s Council, Elena Shishkina, reads.
“I recall that the plan for the deportation of the people of Donbass by its very essence is a genocide of residents of the Republics. The provisions of this reintegration project violate not only human rights and freedoms enshrined in the country’s supreme law, the Constitution of Ukraine, but also the norms of international law.
According to the Law of Ukraine “On the National Security and Defense Council of Ukraine”, the functions of this agency are to propose to the President of Ukraine regarding the implementation of the fundamentals of domestic and foreign policy in the field of national security and defense, and to coordinate and monitor the activities of executive authorities in the field of national security and defense under martial law or emergency state and in the event of crisis situations that threaten the national security of Ukraine.
I would like to draw attention to the fact that the competences of the National Security and Defense Council of Ukraine include:
– elaboration of issues related to the field of national security and defense, and subsequent submission of these proposals to the President of Ukraine in accordance with its research;
– initiation of the development of normative acts and documents on national security and defense issues, summarizing the practice of their application and the results of inspections of their implementation;
– coordination and control of the transfer of central and local executive authorities, along with the country’s economy to functioning under martial law or state of emergency.
Thus, the plan for the deportation of the people of Donbass is fully consistent with the functions assigned to the NSDC.
Further on I would like to draw attention to the date of the document — October 29. I also want to note that the President of Ukraine is the President of the National Security and Defense Council, Vladimir Zelensky.
And it was precisely on October 29, when Zelensky met with representatives of the National Security and Defense Council on the sidelines of the forum to discuss the reintegration of Donbass, and it was also on October 29, when the first stage of the disengagement of forces and hardware began in Stanitsa Luganskaya. It is quite obvious that this document came as a result of these two important events. Having received approval from the Chairman of the National Security and Defense Council, the deportation plan was sent to the interested parties — the Head of the President’s Office, the Prime Minister and the Head of the SBU.
Along with that, the deportation plan is set out on the official letterhead of the National Security and Defense Council of Ukraine, which is confirmed by numerous documents posted on the official website of the National Security and Defense Council of Ukraine for the period from 2014 to date. It is especially worth noting that the old street name is also used in 2019 forms, although Komandarma Kameneva Street was renamed in 2015 during decommunization and was named Petra Bolbochan Street. Therefore, the comments of the NSDC Secretary A. Danilov do not withstand critical evaluation: he does not even know which forms are used by his agency, and his entire refutation of the official deportation plan is based on the words “this is fake.”
At the same time, we can see not an official statement by the NSDC official, but some kind of speech by another member of the “95 Kvartal” team, who has got cornered and urgently needs to prove himself.
The best refutation of the plan for the deportation of the people of Donbass on the part of the National Security and Defense Council and concurrently President Ze can only be the fulfillment of the paragraphs of the Package of Measures envisaged by the Minsk Agreements and granting special status to Donbass by amending the Constitution of Ukraine.
However, Kiev authorities, even trying to refute their position regarding the population of Donbass, have cynically managed to once again reaffirm to the entire international community their being committed to the principles of fascism and Nazism. Thus, they are again proving that the people of Donbass, in violation of the UN Convention on the Protection of Rights and Freedoms, have been subjected to genocide and extermination for six years now.
I would like to remind Ukrainian politicians that, according to the Constitution of Ukraine, human rights and freedoms are inalienable and inviolable, everyone has the right to life, respect for his honour and dignity, the right to freedom of movement and free choice of place of residence. All these norms are inalienable and must be guaranteed by the state. What legal state can Ukraine talk about if the constitution, the inviolable code of the country’s laws, is for them just a bunch of words on paper that can easily be violated without being held responsible for doing this. This document also violates the norms of the European Convention on Human Rights, ratified by Ukraine,” Elena Shishkina said.
