О ходе переговорного процесса по вопросу подписания декларации о запрещении применения пыток и любых форм насилия к удерживаемым на Украине и в Республике лицам в интервью корреспонденту официального сайта ДНР рассказала Уполномоченный по правам человека Дарья Морозова.
«У нас есть четкие доклады ООН по ситуации с правами человека на территории Украины и ДНР. Там отражены все случаи пыток и, что немаловажно, ответственность за эти нарушения. И в 80-90% случаев она лежит именно на правительстве Украины, это четко прописано. Почему мы поднимаем вопрос о декларации? Сейчас, например, Юлию Просолову перевели в Тернопольскую женскую исправительную колонию. Я уже не говорю о том, что она каким-то образом «потерялась» во время этапирования на 2 недели, каким издевательствам она подвергалась со стороны пенитенциарных служб и СБУ и что на данный момент с ней делают в Тернопольской колонии. Ее мама написала на мое имя и на господина Фриша заявление с просьбой поднять вопрос о ее переводе, даже не на нашу территорию, а в Донецкую или Харьковскую область. Тем более что по решению суда Юлия именно в Харькове должна была отбывать наказание. Поэтому нами был инициирован данный вопрос, тема обсуждалась даже в рамках Трехсторонней контактной группы. Надеюсь, что проблема все-таки решится.
Но зная, что пережила Юлия, нами опять был поднят вопрос о подписании декларации, запрещающей пытки, сексуальное насилие и тому подобное. Уже больше года мы готовы подписать этот документ, с нашей стороны препятствий никаких нет. Препятствия идут с украинской стороны, которые заявляют о необходимости включения в декларацию пункта о допуске в тюрьмы Российской Федерации. Это полнейший абсурд, потому что конфликт внутренний, и пытки на данный момент применяет именно украинская сторона. Манипулируя политическим принципом втягивания в конфликт России, они не хотят ничего подписывать. Им это просто невыгодно», — констатировала омбудсмен.
В завершение Дарья Морозова подчеркнула, что важность подобного документа признается уже и мировым сообществом.
Human Rights Commissioner Darya Morozova, in an interview with a correspondent of the DPR official website, spoke on the progress of the negotiation process regarding the signing of the declaration on the prohibition of torture and any kind of violence against persons being detained in Ukraine and in the Republic.
“We have clear UN reports on the human rights situation in the territory of Ukraine and in the DPR. They document all the cases of torture and, equally important, those responsible for these violations. And in 80-90% of the cases this rests precisely with the government of Ukraine, this is clearly spelled out. Why do we raise the issue of the declaration? Now, for example, Yulia Prosolova has been transferred to the Ternopol female correctional facility. I’m not even talking about the fact that she was somehow “lost” for 2 weeks during the transfer, what kinds of victimization she suffered from the penitentiary services and the Security Service of Ukraine and what is currently being done to her in the Ternopol facility. Her mother sent me and Mr. Frisch an appeal asking to raise the issue of her transfer, not even to our territory, but to the Donetsk or Kharkov region. Moreover, by decision of the court, Yulia should have served her sentence in Kharkov. Therefore, we initiated this issue, the subject was discussed even within the framework of the Trilateral Contact Group. I hope that the problem will be finally solved.
But being aware of what Yulia had survived, we again raised the issue of signing the declaration prohibiting torture, sexual abuse and the like. For more than a year we have been ready to sign this document, there are no obstacles on our part. The obstacles are coming from the Ukrainian party, who declare the need to include a clause on admission to prisons in the Russian Federation in the declaration. This is utterly absurd, because the conflict is internal, and it’s the Ukrainian side that currently applies torture. By manipulating the political principle of drawing Russia into the conflict, they do not want to sign anything. It is just unprofitable for them,” the ombudsperson stated.
In conclusion, Darya Morozova stressed that the world community had already recognized the importance of such a document.
